OpenClaw HIPAA Compliance Guide — What You Actually Need

If you are deploying OpenClaw agents in a healthcare setting, HIPAA is not something you can deal with later. It applies the moment your agent touches Protected Health Information, and the penalties for getting it wrong start at $100 per violation and scale to $1.5 million per category per year. The good news is that HIPAA compliance for AI agents is not as mysterious as it sounds once you understand what the regulation actually requires.

## The Basics: What HIPAA Means for Your Agent

HIPAA has three main rules that matter for AI agent deployments. The Privacy Rule governs who can access PHI and under what conditions. The Security Rule specifies technical safeguards for electronic PHI. The Breach Notification Rule tells you what to do when something goes wrong.

For OpenClaw agents, the Security Rule is where you will spend most of your time. It requires administrative safeguards (policies, training, risk assessments), physical safeguards (data center security, workstation controls), and technical safeguards (access controls, audit logs, encryption, transmission security).

The critical point is that these requirements apply to the entire chain. Your agent, the infrastructure it runs on, the LLM provider it calls, the logging system that stores conversations — every component that touches PHI needs to be covered.

## Business Associate Agreements: The First Step Nobody Takes

Before your agent processes a single patient record, you need Business Associate Agreements with every vendor in the chain. This includes your cloud hosting provider, your LLM API provider (OpenAI, Anthropic, Google, etc.), any analytics or logging service that receives conversation data, and any third-party integration your agent calls.

A common failure mode: teams sign a BAA with AWS or Google Cloud but forget that their LLM provider also receives PHI through API calls. Every major LLM provider now offers BAAs, but you have to request them. Without a signed BAA, every API call containing PHI is a violation. This is not a grey area.

## What to Actually Implement

Start with PII and PHI detection. Your agent needs a filter that runs on every input and every output. Before any data leaves your controlled environment — whether to an LLM API, a logging system, or an analytics platform — it passes through a PHI detector. The detector should catch the obvious identifiers (names, dates of birth, SSNs, medical record numbers, health plan IDs) and the less obvious ones (device serial numbers, URLs, biometric identifiers, photographs).

Next, implement audit logging. HIPAA requires that you record every access to systems containing ePHI. For an AI agent, that means logging every conversation, every skill invocation, every database query, and every external API call. The logs need timestamps, user identifiers, what data was accessed, and what action was taken. Critically, the logs must be tamper-proof — an append-only store that nobody can edit or delete.

Third, encrypt everything. Data at rest gets AES-256 or equivalent. Data in transit gets TLS 1.2 or higher. No exceptions. This applies to your database, your log storage, your API calls, and any temporary files your agent creates during processing.

Fourth, implement access controls. Your agent should operate on the principle of minimum necessary access. If a scheduling agent only needs calendar data and patient names, it should not have access to medical records, billing information, or insurance details. Skill-level permission boundaries enforce this.

## The Audit: What They Actually Check

Having been through HIPAA audits with multiple customers, I can tell you what auditors focus on. They want to see your risk assessment document — not a template you downloaded, but a real assessment that maps your specific agent architecture and identifies your specific risks. They want to see your BAAs for every vendor. They want to pull a random week of audit logs and trace a PHI access event from start to finish. They want to see that your access controls work by testing them, not by reading your policy document.

The single best thing you can do before an audit is run a mock audit yourself. Pick a random day, pull your logs, and try to answer: who accessed PHI, when, why, and was it authorized? If you cannot answer those questions from your logs, you have work to do.
