GDPR Requirements for AI Agents: What You Actually Need to Do

The General Data Protection Regulation was written in 2016, years before AI agents became practical. It never mentions agents, skills, or autonomous systems. Yet GDPR absolutely applies to AI agents that process personal data of EU residents. The penalties for non-compliance are steep: up to 4% of global annual revenue or 20 million euros, whichever is higher.

Which GDPR Articles Apply to AI Agents?

Article 5 establishes the core principles: lawfulness, purpose limitation, data minimization, accuracy, storage limitation, and accountability. For AI agents, data minimization is the hardest. Agents naturally want more context to give better answers, but GDPR requires you to process only the minimum data necessary for the task.

Article 22 covers automated decision-making. If your agent makes decisions that significantly affect people, like approving loans, screening job candidates, or determining insurance eligibility, users have the right to human review. Your agent architecture needs an escalation path for these decisions.

Article 35 requires Data Protection Impact Assessments for high-risk processing. Any AI agent handling sensitive personal data (health records, financial info, biometric data) triggers this requirement. The assessment must document the processing purpose, necessity, risks to individuals, and mitigation measures.

Practical Implementation Steps

Start with data mapping. Document every piece of personal data your agent receives, processes, stores, and transmits. That includes conversation logs, memory files, skill inputs and outputs, and any data sent to external LLM providers. If your agent sends conversation data to Claude or GPT-4 for processing, that's a data transfer that needs a legal basis.

Next, implement PII detection and stripping. Before any personal data leaves your controlled environment, whether to an LLM API, a logging system, or an analytics platform, it should pass through a PII filter. Finally, build consent and deletion workflows. Users must be able to request all data your agent holds about them (Article 15) and request its deletion (Article 17). The LLM Provider Question

One frequently overlooked GDPR issue is the relationship between your agent and its underlying LLM provider. When your agent sends a prompt containing personal data to an API, you're transferring that data to a third party. You need a Data Processing Agreement with the provider, and if the provider is outside the EU, you need additional transfer safeguards under Chapter V.
