GDPR Automated Processing: What AI Agents Must Comply With

Most teams building AI agents know they need to think about GDPR. Fewer have actually read Article 22, which is the provision that deals specifically with automated decision-making. It is short, only a few paragraphs, but the implications for AI agent deployments are significant. If your agent makes or contributes to decisions that produce legal effects or similarly significant effects on individuals, Article 22 creates obligations you cannot ignore.

Article 22: The Core Requirement

Article 22(1) states that individuals have the right not to be subject to a decision based solely on automated processing that produces legal effects or similarly significantly affects them. "Legal effects" covers things like contract termination, loan denial, or employment decisions. "Similarly significant effects" is broader and includes things like service denial, pricing decisions, or access restrictions.

The key word is "solely." If a human reviews and approves every agent decision, Article 22 does not apply in the same way. But if your agent autonomously denies a claim, rejects an application, or restricts access without human involvement, you are in Article 22 territory.

There are three exceptions where automated decision-making is allowed: when it is necessary for a contract, when authorized by law, or when the individual gives explicit consent. Even under these exceptions, you must implement suitable safeguards, including the right to obtain human intervention, express a point of view, and contest the decision.

Data Protection Impact Assessments

Article 35 requires a Data Protection Impact Assessment (DPIA) when processing is likely to result in high risk to individuals. The Article 29 Working Party (now the EDPB) has clarified that automated decision-making with significant effects always requires a DPIA.

A DPIA for an AI agent should document: the purpose and scope of the agent's processing, the categories of personal data involved, the necessity and proportionality of the processing, the risks to individuals, and the measures you are taking to mitigate those risks. This is not a one-time exercise. You need to update the DPIA when the agent's capabilities change, when you add new data sources, or when you expand the agent to new use cases.

I have seen teams treat the DPIA as a checkbox exercise, writing a generic document and filing it away. Do not do this. A well-written DPIA forces you to think through the actual risks your agent creates and is the first thing a Data Protection Authority will ask for during an investigation.

Data Minimization for Agents

Article 5(1)(c) requires data minimization: you may only process personal data that is adequate, relevant, and limited to what is necessary. This principle creates a direct tension with how most agents work. Agents perform better with more context. A customer service agent that has access to full account history gives better answers than one limited to the current session.

The way to resolve this tension is to be deliberate about what data the agent can access and for how long. Define the minimum data set the agent needs for each skill or task. Use just-in-time data retrieval instead of pre-loading everything into context. Purge conversation history and memory on a defined schedule. Strip or pseudonymize personal data before it enters the agent's long-term memory.

Right to Explanation

Recital 71 of the GDPR (which provides guidance on interpreting Article 22) mentions the right to obtain "meaningful information about the logic involved" in automated decisions. This is sometimes called the "right to explanation." How you satisfy this requirement with a black-box LLM is one of the harder questions in AI compliance.

The practical approach is to log the inputs, outputs, and reasoning traces for every decision the agent makes. You do not need to explain the internal weights of the neural network. You need to explain what data the agent used, what rules or criteria it applied, and how it reached its conclusion. If your agent uses a chain-of-thought or step-by-step reasoning approach, log those intermediate steps. They become your explanation artifact.

For decisions with significant effects, consider generating a structured decision report that includes the input data, the agent's reasoning, the decision, and the factors that most influenced the outcome. This report serves both as your Article 22 safeguard and as evidence for the DPIA.

Cross-Border Data Transfers

Chapter V of the GDPR restricts transfers of personal data outside the European Economic Area. If your agent sends prompts containing personal data to an LLM hosted in the United States, that is a cross-border transfer. The Schrems II decision invalidated Privacy Shield, and while the EU-US Data Privacy Framework is now in place, relying on it requires that your US provider is certified under the framework.

The safest approach for regulated deployments is to keep personal data within the EEA entirely. Use EU-hosted LLM endpoints where available. Where that is not possible, strip personal data before the API call leaves your environment. A GDPR Compliance Template for Agent Configuration

Here is the template we use when configuring a new agent deployment for GDPR compliance:

  1. Purpose limitation — Document the specific purpose of this agent. What decisions does it make? What data does it process and why?
  2. Legal basis — Identify the legal basis for processing under Article 6. For each category of personal data, record whether you rely on consent, contract necessity, legitimate interest, or another basis.
  3. Data inventory — List every personal data field the agent can access, receive, or generate. For each field, document where it comes from, how long it is retained, and who can access it.
  4. Automated decision-making assessment — Does this agent make decisions with legal or significant effects? If yes, document the Article 22 exception you rely on and the safeguards in place.
  5. DPIA status — Has a DPIA been completed? When was it last updated? Who approved it?
  6. Data transfers — Does personal data leave the EEA during agent processing? If yes, document the transfer mechanism and safeguards.
  7. Deletion procedures — How does a data subject exercise their right to erasure for data held by this agent? Document the process and expected timeline.

Fill this out before you deploy. Update it quarterly or whenever the agent's scope changes. Keep it accessible for your Data Protection Officer and for any regulator who asks.
